1. Welcome & Agreement to Terms

Welcome to The Midlife Couturier™.

Our digital publications, journals, workbooks, and educational resources are created to help women reflect on their lives, recognize what still fits, and thoughtfully design what comes next.

This Digital Product Purchase & Use Agreement ("Agreement") establishes the terms under which our downloadable digital products are purchased, accessed, and used.

By purchasing a digital product after being presented with this Agreement and affirmatively accepting its terms during checkout, you agree to be bound by its provisions, subject to applicable law.

If you do not agree to these terms, please do not complete your purchase.

2. Products Covered by This Agreement

This Agreement applies to downloadable digital products sold by The Midlife Couturier™, including:

  • Digital books and e-books

  • Guided journals and reflective workbooks

  • The Foundation Collection

  • The Intensive Collection

  • Printable worksheets and educational resources

  • Other downloadable digital materials expressly identified as covered by this Agreement

Online courses, coaching services, memberships, physical merchandise, and personalized services may be subject to separate agreements.

Product descriptions, prices, included materials, and delivery formats are presented on the applicable product sales page.

3. Digital Delivery & Access

Digital products are generally delivered electronically through our designated sales platform, including Payhip.

Upon successful payment, customers will ordinarily receive access to their purchased digital files through a download page, email confirmation, or other method specified during checkout.

Customers are responsible for providing an accurate email address and ensuring that their devices and software can open the file formats identified in the product description.

If a customer experiences difficulty receiving, accessing, or opening a purchased product, they should contact us through our website.

We will make reasonable efforts to resolve verified delivery problems, restore access, or provide an appropriate remedy.

Delivery and access remain subject to applicable consumer protection laws.

4. Personal-Use License

Purchasing a digital product grants the customer a limited, non-exclusive, non-transferable, revocable license to access and use the purchased material for personal, non-commercial purposes.

The purchase does not transfer copyright ownership, trademark ownership, or other intellectual property rights.

Under this license, customers may:

  • Download and save the purchased product for their own personal use.

  • Print reasonable copies of worksheets or journal pages for their own personal use.

  • Complete exercises, journal prompts, and activities privately.

  • Revisit purchased materials for continued personal learning and reflection.

Unless otherwise expressly authorized, this license is granted to one individual purchaser.

Any revocation or termination of this license must be consistent with applicable law and the customer's statutory rights.

5. Prohibited Uses & Redistribution

Except where expressly authorized in writing or permitted by applicable law, customers may not:

  • Resell, redistribute, sublicense, or commercially distribute purchased materials.

  • Upload complete purchased products to public websites, file-sharing services, or shared resource libraries.

  • Share purchased files with individuals who have not obtained their own license.

  • Reproduce substantial protected portions of the materials for commercial purposes.

  • Remove or alter copyright notices, proprietary markings, or licensing information for the purpose of misrepresenting ownership.

  • Represent our original protected materials as their own work.

  • Use purchased materials to create competing commercial products that unlawfully reproduce protected expression.

These restrictions do not prohibit lawful quotation, commentary, criticism, fair use, or other rights recognized by applicable law.

Permission for uses outside the personal-use license may be requested through our website.

6. Copyright & Intellectual Property

The Midlife Couturier™'s original written content, educational materials, creative arrangements, photographs, and other qualifying original works are protected by applicable copyright law.

Copyright and other intellectual property rights remain with their respective owners.

Certain materials may include properly licensed third-party content or AI-assisted creative elements. No claim of exclusive copyright ownership is made over material that is not legally eligible for such protection or not owned by the seller.

Purchasing a product does not grant permission to reproduce, publish, sell, or commercially exploit its protected content beyond the license expressly provided in this Agreement.

We reserve the right to investigate suspected infringement and pursue lawful remedies, including appropriate takedown requests and legal action.

7. Trademarks & Brand Identity

The Midlife Couturier™, Tailored Living™, and other names, logos, and identifiers used to distinguish our goods or services may be claimed as trademarks or service marks.

Use of the ™ symbol does not represent a claim of federal trademark registration.

Customers may not use our protected brand identifiers in a manner likely to cause confusion regarding the source, sponsorship, approval, or affiliation of products or services.

Nothing in this Agreement prohibits lawful descriptive, referential, or other legally permitted use of a mark.

All trademark rights claimed are subject to applicable law and existing third-party rights.

8. Refunds & Cancellations

Because downloadable digital products are generally made available immediately after purchase and may be retained after downloading, purchases are ordinarily final.

We do not generally offer discretionary refunds for changes of mind or dissatisfaction with a product's content when the product has been accurately described and delivered as promised.

However, customers may be entitled to refunds or other remedies where required by law, including circumstances involving non-delivery, defective digital files, material misdescription, or other legally protected claims.

Customers experiencing purchase problems are encouraged to contact us so that we may investigate and offer an appropriate resolution.

Our separate Refunds & Digital Product Policy, made available before purchase, provides additional information and is incorporated into this Agreement to the extent consistent with applicable law.

If provisions conflict, mandatory consumer protections prevail.

9. Chargebacks & Payment Disputes

We encourage customers to contact The Midlife Couturier™ directly regarding billing errors, unauthorized charges, delivery difficulties, or other purchase concerns.

Customers agree not to knowingly submit fraudulent payment disputes or intentionally misrepresent whether purchased digital materials were delivered or accessed.

In response to a payment dispute, we may provide relevant transaction records, evidence of delivery or access, purchase confirmations, and records of customer acceptance of applicable policies to the payment processor, financial institution, or dispute administrator.

Any personal information shared for this purpose will be handled in accordance with applicable privacy law.

Where permitted by law and applicable payment processor rules, we may suspend or revoke access associated with a refunded or reversed transaction.

Nothing in this Agreement limits or waives a customer's legal right to dispute unauthorized transactions, billing errors, non-delivery, or other protected payment issues.

10. Educational Purpose & No Guaranteed Outcomes

Our digital products are intended for educational, reflective, and general personal-development purposes.

They are not intended to provide individualized medical, mental health, psychological, legal, financial, or other licensed professional advice.

Our books and workbooks encourage independent reflection and personal decision-making. They are not a substitute for professional evaluation or treatment where such services are needed.

Individual experiences and results will vary.

We do not guarantee specific personal, emotional, relationship, career, financial, or lifestyle outcomes from purchasing or using our materials.

Customers remain responsible for their own decisions and actions.

11. Third-Party Platforms

Purchases and delivery may be facilitated through third-party platforms, including Payhip and its supported payment processors.

These platforms may impose additional terms concerning payment processing, platform access, technical services, and dispute handling.

The Midlife Couturier™ remains responsible for its own obligations as the seller to the extent required by applicable law.

If a platform's terms conflict with this Agreement, the relevant contractual obligations and applicable law will determine which provisions govern.

12. Force Majeure

The Midlife Couturier™ shall not be responsible for delays or failures to perform contractual obligations to the extent directly caused by extraordinary circumstances beyond its reasonable control.

Such circumstances may include natural disasters, wildfires, earthquakes, severe weather events, war, government emergencies, widespread telecommunications failures, major hosting disruptions, or other comparable events.

We will make reasonable efforts to minimize disruption, communicate with affected customers when practicable, and restore access or performance within a reasonable period.

This provision does not excuse obligations that can reasonably be performed, nor does it remove statutory refund, cancellation, or other consumer rights.

13. Disclaimer of Warranties

To the extent permitted by applicable law, digital products are provided without warranties beyond those expressly stated in their product descriptions or otherwise required by law.

We make reasonable efforts to provide accurate descriptions and functional digital files.

We do not guarantee uninterrupted availability of third-party platforms or compatibility with every device or software application.

Nothing in this provision excludes warranties or remedies that cannot legally be excluded.

14. Limitation of Liability

To the fullest extent permitted by applicable law, The Midlife Couturier™ shall not be liable for indirect, incidental, special, or consequential damages arising from the use or inability to use purchased digital products.

Any limitation of liability will apply only where legally enforceable and will not exclude liability that cannot lawfully be limited, including liability arising from fraud, intentional misconduct, or other protected claims.

Nothing in this Agreement removes rights or remedies guaranteed under applicable consumer protection laws.

15. Termination of License

We may suspend or terminate a customer's license if the customer materially violates this Agreement, including by engaging in unauthorized commercial redistribution of protected materials.

Where reasonable and appropriate, we may provide notice and an opportunity to resolve the violation.

Termination does not eliminate rights or remedies that survive under applicable law.

Any termination or access restriction will remain subject to mandatory consumer rights.

16. Governing Law & Dispute Resolution

Subject to applicable mandatory consumer protections and any controlling third-party platform agreements, this Agreement is intended to be interpreted under the laws of the State of California, United States.

Nothing in this provision deprives consumers of protections or legal remedies that cannot lawfully be waived.

Customers are encouraged to contact us regarding concerns before initiating formal proceedings, but doing so is not a condition of exercising any statutory right.

Any additional provisions concerning court jurisdiction, venue, arbitration, or dispute procedures will be established only following legal review.

17. Changes to This Agreement

We may revise this Agreement to reflect changes in our products, business practices, technology, or legal obligations.

Updated versions will be posted with a revised effective date.

Changes will apply prospectively unless otherwise lawfully agreed. Material changes affecting existing purchases will not automatically eliminate rights granted under the terms applicable at the time of purchase.

18. Severability

If a provision of this Agreement is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law and consistent with the Agreement's essential purpose.
